These Terms of Service ("Terms") govern your access to and use of the BRDiagnostics platform, including our website, APIs, and related services (collectively, the "Service"). The Service is operated by BRDiagnostics — referred to in these Terms as "BRDiagnostics", "we" or "us". By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
BRDiagnostics reserves the right to modify these Terms at any time. We will notify registered users of material changes via email or platform notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
You must be at least 18 years old and have the legal capacity to enter into binding agreements to use our Service. If you are using the Service on behalf of a business entity, you represent that you have authority to bind that entity.
BRDiagnostics provides remote vehicle diagnostic services and digital file products for supported vehicle platforms. Our services include but are not limited to: remote diagnostic sessions carried out over a secure connection, the generation and signing of vehicle configuration and coding files (such as NCD and FSC files), VIN-based vehicle data lookups, and related digital products.
Services are paid for through a service plan that includes a periodic service allowance, or per individual order. Service availability, processing times, and supported vehicle platforms may vary and are subject to change without prior notice. We strive to process all orders within the timeframes indicated on our platform, but these are estimates and not guarantees.
* Estimated delivery times. Most digital file orders — such as NCD, FSC and other automated signing products — are delivered within a few seconds of a successful order. In some cases delivery may take longer: for example when an order requires manual review, relies on the vehicle manufacturer's online systems, or during periods of high demand. The "usually a few seconds" estimate shown during checkout is therefore indicative and not a guarantee; if processing takes longer than expected, you will be notified as soon as your file is ready.
You are responsible for ensuring that any modifications made to your vehicle comply with local laws and regulations. BRDiagnostics provides technical processing services only and does not guarantee legal compliance in your jurisdiction. It is your responsibility to verify that requested services are lawful in your region before placing an order.
Our platform operates on a prepaid basis. You can subscribe to a service plan that includes a periodic service allowance, or pay for individual orders directly. Prices are displayed in the applicable currency at the time of purchase.
All payments are final and non-refundable, except where required by applicable consumer protection laws. A plan's service allowance applies to the billing period in which it is granted: it refreshes in full at the start of each new period, and unused allowance does not carry over between periods. Any remaining prepaid balance outside a plan stays available for as long as your account remains active and in good standing.
If you upgrade to a plan with a larger service allowance, any allowance remaining on your current plan is used first; the new plan's allowance becomes available automatically once that remainder is used up, and your account status is updated to reflect the change. A single order may draw on the end of your current plan's allowance and continue automatically from the new plan's allowance, completed as a single transaction. Upgrading does not refund or shorten the billing period you have already paid for; the new plan takes effect immediately, applying as described above. At this time, plan changes are available as upgrades only. If you subscribe to a plan while an existing prepaid balance remains on your account, that balance is used first; the plan's service allowance starts counting once the existing balance has been used up, and a single purchase may draw on both in one transaction.
Repeat-service benefit. For selected products we may offer a repeat-service benefit: where enabled, ordering the same product again for the same vehicle (identified by its VIN), from the same account, within a limited product-specific time window after an order that was successfully paid or covered by your plan, is not charged. Where offered, the applicable window is shown at order time. This benefit is discretionary and product-specific; it may be modified or withdrawn at any time, does not apply to orders that were cancelled, refunded or never paid, remains subject to fair-use limits and technical availability, and repeat orders are otherwise governed by these Terms in full.
Right of withdrawal (EU/EEA consumers): if you order as a consumer, you normally have a statutory 14-day right of withdrawal for online purchases. Our digital products are delivered immediately after a successful order. By confirming an order for digital content you expressly request immediate performance and acknowledge that you lose your right of withdrawal once delivery has begun, in accordance with Article 16(m) of Directive 2011/83/EU. Where delivery has not yet begun, your statutory rights are unaffected.
If a service cannot be completed due to technical limitations on our end, the amount paid for that service will be returned to your account balance or refunded. We reserve the right to adjust pricing for service plans and individual services at any time; changes take effect no earlier than your next billing period and do not affect amounts already paid.
BRDiagnostics provides services "as is" and makes no warranties, express or implied, regarding the fitness of processed files for any particular purpose. While we employ rigorous quality control procedures, you acknowledge that ECU modifications carry inherent risks.
To the maximum extent permitted by law, BRDiagnostics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim.
You agree to indemnify and hold harmless BRDiagnostics, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent court in the Netherlands, unless mandatory consumer-protection law grants you the right to bring proceedings in your country of residence.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The failure of BRDiagnostics to enforce any right or provision shall not constitute a waiver of that right or provision.
